Legislature base of culture and intercultural relations in Tajikistan

ABSTRACT:

Transition period from the soviet period into the building of the new relations is closely connected with the strategy of integration of basic national cultural values into modern world normative-legislature system. It needs, however, a hard work to study experience of the modern world, re-thinking that experience, finding the links of national standards and the common-world standards of the changing world. As a person actively involved into the process of law-creativity and a head of the key department of Ministry of Justice of RT, I know advantages and disadvantages of nowadays process of building new legislature system of the country. What are the new, recent points of national legislature system, which can provide more full knowledge and push for creativity, opening new perspectives of cultural and intercultural cooperation with the countries of Central Asia inwardly and CA and EU outwardly?

One of the crucial steps in that process is ratification of the Convention of Protection and Promotion of diversity of cultures in RT, which has been issued at 20.Octobre 2005 in Paris. The other step is the Programme of development of culture in Tajikistan for 2008 to 2015. The program actualized the plan of more then twenty cultural events of national and international character. It also projected essential financing for the cultural development of the country.

The structure of the Ministry of Culture and also new statement, defining concrete functions and tasks of the officers and clerks in development of culture has been improved in December 2006.

One of the really important essential problems is a problem of highly qualified cadres in the sphere of culture. In that respect the Government has published a statement on 3.06.06 N239 “About the State programmed of promoting qualified cadres in the field of culture, art and polygraph”. The core of the statement is organization of universal educational system in the field of professional trainings, re-searching arts in their interconnections, developing the content of teaching, promoting and encouraging artistic and scholarly activity of teachers, artists, promoting the prestige of the specialists of culture and arts in society etc.

An important event in building of the legislature system in RT is the issue of the ‘Law of RT’. About safety and utilization of the objects of historico-cultural heritage’. It is a new editing of the Law in the context of the new challenges of the time. The Law is strategiesed for the regulation of public relations in the sphere of historic-cultural heritage for providing their safety and effective utilization for the further development.

Generally specking, a number of the new laws, such as ”The Law About the Culture”, “The Law of development of culture in RT”, “About export and import of cultural values”, “About museums and museums funds”, “About theatre and theatrical activity”, Concept of development of culture, worked out in 2005 etc. are very important essential national legislative system of culture. That system, however, can not be actual without inward/outward intercultural activity in Central Asia and Europe. Actualization of that system is closely connected with the reforms in education, in social sciences and human sciences, as a whole.
